Health Declaration
Persons taking a sea voyage must sign our health declaration, persons under the age of 18 must be signed for by a parent or guardian. The declaration you will be required to sign reads;
Sea voyages may involve sudden movement and sudden impact. I confirm that I am18, or that this has been signed for on my behalf by a parent / guardian, and that I have no existing medical conditions that would be aggravated by the movement of the boat including, a heart condition, any skeletal weakness, pregnancy and epilepsy. I also understand that this is a dangerous activity and that I undertake it at my own risk. I confirm that this is the point of contract. I am under no obligation to make this voyage due to any prior contact with Sail Southwold staff. By signing this declaration, I agree to be bound by the terms and conditions of Sail Southwold Limited.
Your personal details will not be passed on to third parties or used for promotional purposes, however, we are required to keep them for administration purposes.
By signing the Passenger Declaration I agree to the Terms and Conditions of Sail Southwold Ltd.
TERMS & CONDITIONS
These are the only terms in which we offer Boat trip services, please read them carefully prior to booking with us. Other important information such as our Declaration form, policies and procedures and health and safety documentation can be requested through our website or at our office at any time.
- OUR SERVICES
1.1 We offer a range of trip choices that are detailed online, Terms applicable to these are set out in clause 1.
1.2 Passenger changes. If you wish to change or update the details of any passenger, please inform us which passenger is being replaced/updated, and supply the full appropriate details of the new/updated passenger. New passengers must complete all appropriate documentation before arrival and are subject to acceptance by the Skipper.
1.3 When participating with us you must;
- Not smoke (whether conventional or electronic cigarettes).
- Not behave in a manner that is abusive or threatening or causes offence to other customers or staff.
- Not consume or be under the influence of any alcohol.
- Not play loud music or operate any personal device at a volume that may be disruptive to others.
- Take all rubbish home or place it in appropriate bins.
- Do not interfere with the boat or equipment fitted to the boat.
- Not to deliberately or recklessly damage or deface any part of the boat/site or equipment provided
- 2. BOAT AND PROTECTIVE EQUIPMENT
2.1 Life Jackets. We have a strict policy that Life Jackets are to be worn at all times when on the boat or approaching the water. Failure to comply with this may result in the cancellation of your trip and/or refusal to allow you to participate.
- Deliberate activation of lifejackets in inappropriate circumstances will result in £40 penalty charge, per jacket.
2.2 Images. Images of boats on the website are for illustrative purposes only.
2.3 Responsibility. You will be responsible at all times for the equipment allocated to you and/or that you are in use of for the duration of the trip. You, the customer, will be liable for any loss of damage incurred during the trip.
2.4 Security. Our equipment is not to be left unattended at any time, unless locked away securely by staff.
3. GIFT VOUCHERS
3.1 Gift vouchers may be purchased and are valid/redeemable towards the trip or amount stated on them.
3.2 We do not hold any responsibility for lost/damaged vouchers once they have been purchased and passed over to the customer.
3.3 Gift vouchers may not be used to purchase further gift vouchers.
4. PHOTOS
4.1 You may take your own photographs or videos on our premises but you must be confident that you are not causing a hazard to other passengers when filming or taking photographs. We reserve the right to ask you to cease photographing or filming at any time for any reason.
5. BOOKING ACCEPTANCE
5.1 Your booking is accepted once payment is received, you will receive confirmation containing the appropriate details once payment has been taken.
5.2 You must supply us with the required information in order to go through with your booking (declaration).
6. PAYMENT
6.1 Payment for trips must be made in full, upfront before the trip date.
6.2 If you wish to cancel a booking, you may do so and receive a refund of the total minus 5% any time up to 48 hours before the trip. A cancellation within 48 hours of the booking will result in no refund being awarded.
6.3 Refunds must be made via the method of payment.
6.4 Refunds requested by the customer will be subject to a 5% deduction from the overall total to cover administrative expenses.
7. CHANGES TO YOUR BOOKING
7.1 If for any reason, you wish to make a change to your booking, please inform as far in advance as is possible, this will allow us to accommodate your changes as best as possible.
7.2 If at any time we need to change or cancel your booking, you will be notified at the earliest possible time.
7.3 We may from time to time need to cancel or move trips/bookings, this may be due to unforeseen circumstances, such as adverse weather or boat maintenance. You will always be notified as soon as possible of this. If we must rearrange your trip, we will always try to find another time/date to suit you, if this is not possible, a refund may be requested.
8. LIABILITY
8.1 You, the customer, are responsible for any/all personal effects/belongings that you bring on site and on trips at all times. We accept no responsibility for your personal belongings at any time. You understand the nature of the trips and understand the risk to personal belongings.
8.2 Where your personal property is lost on site, please let us know as soon as possible. Where we are able to look, if found, we can store lost belongings for up to 30 days, after which time the items may be destroyed or discarded.
8.3 Nothing in these terms excludes or limits our liability to you in any way that cannot be excluded or limited by law.
9. GENERAL TERMS
9.1 Staff representations. Anything said to you by a member of staff or person on our behalf should not be misconstrued as a variant of these terms.
9.2 Safety. For the safety of our team and our customers, we reserve the right to ask anyone to leave our premises at any time if we suspect that anyone is under the influence of drugs or alcohol. Additionally, irresponsible behavior, endangering other passengers, being abusive to staff, other passengers, or causing general disharmony will result in exclusion from our premises.
9.3 Each of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining terms will remain in full effect.
